    @calimar28 That Supreme Court rulings count no matter what. Cardozo’s majority opinion in Helvering v Davis 1937 clearly shows the superiority of Hamiliton’s reading of the general welfare clause “The conception of the spending power advocated by Hamilton and strongly reinforced by Story has prevailed over that of Madison”. It would take a massive change for the Supreme Court to overturn that ruling; it is a not flawed separate but equal ruling. Your other option amend the constitution-unlikely

    @pmagrin Bullshit. That supreme court was a bunch of liberal ass panseys who know what “General Wefare” meant (it meant military, mail service etc…not actual welfare), but ruled on it anyway. We are about to change all of this liberal nonsense.

    @calimar28 Even Fox News(!) showed Ron Paul he was wrong! The Supreme Court ruled Social Security constitutional under the General Welfare Clause in 1937. Ron Paul claimed it was just a liberal ruling. The Constitution made them the final arbiter of what is or isn’t constitutional. If he is a ‘strict constitutionalist’ he should accept their judgement rather than stick his fingers in his ears and scream it’s unconstitutional.

    @letInMe Ron Paul explained it already. General welfare means federal judges, a sound currency, etc – it doesnt mean SPECIFIC welare, which is what you liberals are talking about.

    Read it closely. Pay special attention to the part about “common defence”, and the next 4 words after that.

    Actually, this is a Republic, not a democracy. But, what the hell, let’s change that too! It’s really more of a guideline than a rule…
    Without limits, mob rules. If I can get a “democratic” 51% vote that all liberals should be tortured and executed, I guess you’re OK with that new law then?
    Of course that’s extreme, but Ahmadinejad was elected by “majority” in a government without our constitution to limit his actions. You seem to think it isn’t possible, yet it happens all around us…

    Alright back up there. Who defines what ‘better’ is? No one; which is why we have a democracy so the majority can have their way. I love how you compare apples to oranges, and even bring in totalitarianism. Why would anyone in their right mind toss aside speech or the right to a fair trial? No one. This is a democracy.

    So again, I ask you, why stick strictly to the constitution while we can exist as a democracy without one?

    So who defines what “better” is? Order and submissiveness is better, right? Totalitarian control accomplishes this in a prison, but I’m not to keen on it in a free society.
    This country was founded as a response to oppressive, intrusive government interference. These are our principles. Which other’s get tossed aside because someone thinks it’s better? Speech? Right to fair trial?

    Understand that the “CONSITUTION” is not supreme law of the universe. It’s a great document but you must be absurd to think that it has permanence, if there’s a change to make the nation better but it’s not defined in the Constitution, who cares? It doesn’t make sense.

    Budget: The CONSTITUTION requires the Federal gov’t to provide ‘a common defence”, NOT health care, or education, or any other states responsibilities.
